Preamble
These Terms of Use and Terms of Sale govern access to the myhandiqr.com website and use of the myHandiQR service, an inclusive communication platform that complies with European standards.
This document is divided into two parts. The first part (Terms of Use) describes the conditions for accessing and using the service. The second part (Terms of Sale) sets out the commercial terms applicable to the paid subscription.
By creating an account, publishing a profile or subscribing to a paid plan, you acknowledge that you have read, understood and accepted these terms in full.

Definitions
For the purposes of these terms, the following words have the meanings set out below.
- Service or platform: the myhandiqr.com website and all the features that allow a myHandiQR profile to be created, edited, published and viewed.
- Creator: the adult natural person who holds an account and who creates a profile for themselves or, as the holder of parental authority, for their minor child.
- Subject: the person whose information appears on the profile. The subject may be the creator themselves or their minor child.
- Profile: the structured set of information entered by the creator, describing the subject's disability and the explanations tailored to the different types of people who may interact with them.
- Card: the version of the profile displayed at the time of the scan, tailored to the type of viewer identified.
- QR code: the unique visual code, generated by the platform, that points to the subject's online card.
- Viewer: the person who scans the QR code and consults the card after stating their age and their role.
- Account: the creator's personal space, which lets them manage one or more profiles.
- Subscription: the paid services contract giving access to the full features of the service beyond the trial period.
Purpose and acceptance of the Terms of Use
The purpose of these Terms of Use is to define the conditions under which myHandiQR makes the service available to the creator, and the conditions under which the creator uses it.
Use of the service implies full and complete acceptance of these Terms of Use. This acceptance is recorded when the account is created, by means of a separate checkbox. Anyone who does not accept the Terms of Use must refrain from using the service.
The creator declares that they have the legal capacity to enter into a contract and confirms that they are of legal age (at least 18 years old) under the law applicable in their place of residence.
Overview of the service
myHandiQR is an inclusive communication platform that complies with European standards. It allows a person, or the holder of parental authority acting for their child, to create a profile describing a disability and the explanations tailored to the different types of people they may come into contact with.
Each profile is linked to a unique QR code. When someone scans this QR code, they reach a card whose content is tailored to their age and their role.
What myHandiQR is not. myHandiQR is not a medical record, a diagnostic tool, a medical device, or a platform intended for healthcare professionals. No medical diagnosis is collected or required. The information entered consists of practical, caring descriptions written freely by the creator of the profile.
Creating and managing the account
Using the service requires the creation of a personal account. The creator undertakes to provide accurate information when registering and to keep it up to date. Any false declaration may result in the immediate suspension of the account.
The creator is solely responsible for keeping their login credentials confidential. Any action carried out from their account is deemed to be theirs. If fraudulent use is suspected, it is up to the creator to inform myHandiQR without delay and to change their password.
A single creator may manage several profiles from the same account (for example, a parent who creates a profile for each of their children concerned).
Creating a profile and shared content
The creator freely enters the information that will make up the profile: a description of the disability, needs, behaviors, practical tips, and explanations tailored to each type of viewer. No diagnosis field is required by the platform.
The creator decides themselves which information is made visible depending on the type of viewer's profile (friend, classmate, colleague, teacher, neighbor, parent, etc.). They can adjust the level of language of the explanations so that they can be understood by a child as well as by an adult.
The content of the profile can be edited at any time from the personal space. The QR code itself does not change: the same printout can be kept over time while the content evolves.
Consent to the processing of disability-related data
The information entered in a profile constitutes personal data and falls within a special category within the meaning of article 9 of Regulation (EU) 2016/679 (GDPR, the EU General Data Protection Regulation), in that it concerns the disability of a natural person.
The processing of this data by myHandiQR is based on the explicit consent of the creator, or of the holder of parental authority where the profile concerns a minor. This consent is collected separately from acceptance of the Terms of Use, by means of a separate checkbox when the profile is created.
Consent is freely given, informed, specific and may be withdrawn at any time from the personal space. Withdrawing consent results in the immediate deactivation of the profile and the associated QR code.
Profiles created by a parent for a minor child
When a profile concerns a minor child, the account is created and managed by the holder of parental authority. The latter declares, when creating the profile, that they are acting freely and in the child's interest.
The holder of parental authority is responsible for the published content and for the conditions under which the QR code is shared. They undertake to inform the child, depending on their age and maturity, of the existence of the profile and of how it will be used.
When the child reaches the age of majority, or earlier at their request, the profile and the associated account may be transferred to their exclusive control. The practical arrangements for this transfer are described in the personal space.
How the QR code works and the viewer's experience
The QR code generated by the platform points to a unique URL corresponding to the subject's card. The subject, or the holder of parental authority acting on their behalf, freely decides who they show this QR code to and in what context.
When someone scans the QR code, they are invited to state their age and then to choose a profile from a suitable list (for example, classmate, colleague, neighbor, parent). They then reach the card, whose content is filtered according to the rules defined by the creator.
No information identifying the viewer is requested or kept. The age and profile entered are used only to determine how the card is displayed at the time of viewing.
Intellectual property
All the elements that make up the myHandiQR platform (software, source code, interfaces, trademarks, logos, texts, editorial content, illustrations, visual identity, card structure, algorithms for adapting the explanations) are the exclusive property of the company myHandiQR or are used under license. Any reproduction, representation, adaptation or use, in whole or in part, without prior written authorization, is prohibited.
The creator retains the intellectual property of the content they publish on the profile. They grant myHandiQR a non-exclusive, free license limited to the duration for which the profile is hosted, for the sole purposes necessary to provide the service (storage, formatting, display of the card, generation of the QR code, security backups).
The myHandiQR trademark and logo may only be used by a third party with the prior written agreement of the company.
Liability
As myHandiQR is neither a medical tool nor a diagnostic tool, the company cannot be held liable for decisions made by a third party based on the information displayed on the card, in particular in a school, professional or care setting.
myHandiQR exercises no control over the physical distribution of the QR code once it has been printed or shared by the creator. It is up to the creator to control how it is used and to deactivate the QR code in case of doubt.
myHandiQR cannot be held liable in the event of use of the service contrary to these terms, a false declaration by the creator, a breach of account security through the creator's negligence, or an event constituting force majeure.
Unless a mandatory legal provision states otherwise, and except in the event of gross or intentional fault, myHandiQR's total liability under these terms is capped at the amount of the sums actually paid by the creator under the subscription over the last twelve (12) months.
Suspension and termination for breach
In the event of a serious breach of these terms by the creator, and in particular in the event of the publication of unlawful content, content that infringes the rights of third parties, or content unrelated to the purpose of the service, myHandiQR reserves the right to:
- temporarily suspend access to the account or to a profile;
- immediately deactivate a QR code identified as the medium for disputed content;
- terminate the account as of right, after a notice that has had no effect, or immediately in the event of a particularly serious breach.
Termination for breach occurs without prejudice to any damages that myHandiQR may claim in compensation for the harm suffered.
Personal data and GDPR
myHandiQR acts as the data controller within the meaning of the GDPR (the EU General Data Protection Regulation) for the data collected via the platform. The details of the processing, retention periods, the rights of the people concerned and the arrangements for collecting consent are described in the Privacy Policy.
The creator has the following rights over their own data and the data entered in the profile: access, rectification, erasure, restriction, objection, portability, and withdrawal of consent at any time. These rights are exercised from the personal space or by a request sent via the Contact page.
In accordance with the regulations, the creator also has the right to lodge a complaint with the CNIL (the French data protection authority).
Cookies and trackers
The platform uses the cookies and trackers strictly necessary for the proper functioning of the service (authentication, session management, security). These cookies do not require prior consent.
Other, optional cookies may be placed to measure the website's audience and improve the service. These cookies are only activated after explicit consent collected via the information banner displayed on the first visit. Consent can be withdrawn at any time.
No advertising cookies or third-party tracking cookies for commercial purposes are used. Audience measurement data is never passed on to third parties for commercial purposes.
Security and hosting
The data processed by myHandiQR is hosted within the European Union, on infrastructure selected for its compliance with European data protection requirements. No data is transferred to a third country without an appropriate legal framework.
The data is protected by encryption in transit and at rest. Access to the data by myHandiQR staff is strictly controlled and limited to what is necessary to operate the service.
In the event of a data breach likely to create a risk to the rights and freedoms of the people concerned, myHandiQR notifies the supervisory authority and, where applicable, the people concerned, under the conditions and within the timeframes provided for by the GDPR.
Purpose of the Terms of Sale
The purpose of these Terms of Sale is to define the commercial terms applicable to subscribing to, renewing and terminating a myHandiQR subscription.
They apply to any adult natural person, acting as a consumer within the meaning of the French Consumer Code, who subscribes to a paid plan, for themselves or for their minor child.
The Terms of Sale supplement the Terms of Use. In the event of any contradiction between the two documents on a commercial matter, the Terms of Sale prevail.
Price, trial period and billing cycle
The service is offered under the following pricing terms:
- Free trial period: 3 months from the creation of the account. During this period, all the features of the service are accessible with no commitment and with no payment method collected.
- Annual subscription: $24 per year, all taxes included for users residing in the European Union. Any applicable VAT is stated on the invoice.
- Billing cycle: the subscription is annual and renewable by automatic renewal unless cancelled.
The prices in force are those displayed on the website on the date of subscription. Any price change is subject to prior notice and applies only from the next renewal.
Subscription, payment and invoicing
Subscribing to the paid plan is done from the creator's personal space. The contract is formed when the order is confirmed, recorded by the double click that requires the order details to be reviewed and then expressly confirmed.
Payment is made by bank card or by any other payment method offered on the platform. Transactions are processed by an authorized payment services provider. myHandiQR never has access to the creator's full bank details.
An invoice is made available in the personal space following each payment. The creator can download it freely.
If a payment fails at renewal, access to the paid features is suspended after notice sent to the creator. The profile and its content are retained.
Right of withdrawal
In accordance with articles L. 221-18 et seq. of the French Consumer Code, the creator has a period of fourteen (14) days from the subscription date to exercise their right of withdrawal, without having to give a reason for their decision.
To exercise this right, the creator may send an unambiguous request via the Contact page or use the standard withdrawal form available for download from their personal space.
The refund is made no later than fourteen (14) days after the request is received, using the same payment method as the one used when subscribing, unless expressly agreed otherwise.
Important information: by expressly requesting immediate access to the paid service during the withdrawal period, the creator acknowledges that, if they withdraw once part of the service has already been performed, the refund may be reduced in proportion to the part that has been performed.
Renewal, non-renewal and resumption
The subscription is renewed by automatic renewal at each annual due date, in accordance with the provisions of article L. 215-1 of the French Consumer Code, unless the creator objects from their personal space or by any other means provided for by law.
A notice reminding the creator of the option not to renew the subscription is sent between three (3) months and one (1) month before the due date.
In the event of non-renewal:
- the QR codes associated with the profiles stop working from the due date;
- the account and all the content of the profiles are retained, under the conditions described in the privacy policy;
- read and edit access to the profile remains possible from the personal space.
The creator can resume their subscription at any time. Resumption immediately reactivates the existing QR codes. No new printing is necessary.
Account deletion and data retention
The creator can request the permanent deletion of their account at any time from their personal space. Deletion results in the immediate deactivation of the associated QR codes.
All data relating to the account and the profiles is erased within a maximum of thirty (30) days from the request, with the exception of data that myHandiQR is required to retain under a legal obligation (in particular accounting and tax obligations), for the applicable legal period.
Deleting the account does not give rise to a refund of the sums paid for the current subscription period, except in cases provided for by law (in particular the exercise of the right of withdrawal).
Customer service and complaints
Any question, request for information or complaint can be sent to myHandiQR via the Contact page. Customer service endeavors to respond within a reasonable time, and at the latest within fifteen (15) working days.
For a complaint to be handled as quickly as possible, it is advisable to state the account identifier concerned, the date of the events and a precise description of the matter.
In the event of a dispute, the creator is invited to contact customer service first in order to seek an amicable solution before taking any other action.
Consumer mediation
In accordance with articles L. 612-1 et seq. of the French Consumer Code, a consumer creator has the option, in the event of a dispute that could not be resolved amicably with customer service, of using a consumer mediator free of charge.
myHandiQR is in the process of joining a conventional mediation scheme. The full contact details of the mediator will be provided on this page as soon as the membership is finalized, and can be obtained at any time by a simple request sent via the Contact page.
The creator can also use the European online dispute resolution platform available at ec.europa.eu/consumers/odr.
Use of the mediator is optional and does not prevent a subsequent referral to a competent court.
Applicable law and competent jurisdiction
These Terms of Use and Terms of Sale are governed by French law. They apply without prejudice to the more protective provisions applicable to the consumer creator under the law of their country of habitual residence within the European Union.
Failing an amicable resolution, any dispute relating to the formation, performance or interpretation of these terms will fall under:
- for disputes between professionals, the exclusive jurisdiction of the Paris Commercial Court, the jurisdiction of myHandiQR's registered office;
- for disputes involving a consumer creator, the courts having jurisdiction under the rules of ordinary law, with the consumer being able to bring the matter, at their choice, before the court of the place of their domicile or that of the place of myHandiQR's registered office.
Changes to the terms
myHandiQR reserves the right to amend these Terms of Use and Terms of Sale to take account of changes to the service, the applicable regulations or industry best practices.
Any substantial change is notified to the creator by email and by display in the personal space, at the latest thirty (30) days before it takes effect. During this period, the creator may refuse the new terms by terminating their subscription free of charge.
Continuing to use the service after the new terms take effect constitutes acceptance of them. The applicable version is the one in force on the date the service is used.
